(1) Basic conditions for employers: Legally established, with actual business premises, paying taxes and social insurance in accordance with the law, and having no serious record of illegal or untrustworthy behavior;

The positions for which foreigners are employed should have special needs, be temporarily short of suitable candidates in China, and not violate relevant national regulations.

The wages and salaries paid to the foreigners employed shall not be lower than the local minimum wage standard.

Where laws and regulations stipulate that pre-approval by the industry's competent department is required, approval must be obtained.

(2) Basic conditions for applicants: At least 18 years old, in good health, with no criminal record, having a definite employer within the territory of China, and possessing the professional skills or corresponding knowledge level necessary for their work.

The work they are engaged in is in line with the needs of China's economic and social development and they are urgently needed professionals in the country.

Where laws and regulations have other provisions for foreigners working in China, such provisions shall prevail.
