According to the Nationality Law of the People's Republic of China, foreigners or stateless persons who are willing to abide by the Constitution and laws of China and meet one of the following conditions may apply for approval to acquire Chinese nationality:

The first is the close relatives of Chinese people;

The second type is those who have settled in China;

The third is that there are other legitimate reasons.

When a foreign spouse of a Chinese person applies for Chinese nationality, they should apply to the Exit-Entry administration department of the public security organ at the place of household registration of the Chinese close relative and submit relevant materials such as international travel documents, marriage certificates, and certificates of settlement in China, which will be approved by the Ministry of Public Security.

The "Proof of settlement in China" refers to the "Permanent Residence Permit for Foreigners".

According to the relevant provisions of the "Administrative Measures for the Approval of Permanent Residence of Foreigners in China", the foreign spouse of a Chinese citizen who has been married for at least five years, has continuously resided in China for at least five years, has resided in China for no less than nine months each year and has a stable living guarantee and residence may apply for a permanent residence permit for foreigners.
